Extension of Use Filing
In the event that you require additional time before submitting your Statement of Use for the trademark, you have the option to request an extension. Each such extension will grant you an extra 6 months, thereby providing you with more time to complete the process of registering your trademark. Don’t delay—begin the process right away!
Extend Your Deadline! A Maximum of 5 SOU Extensions Available
Information on the USPTO’s Extension of Use for Your Trademark
If you do not file an extension request within the six months after your Notice of Allowance, your application will be terminated, and the mark cannot be registered. You can choose to apply again later, but your original priority date will no longer be valid.
Trademark applications filed with the basis of Intent to Use demand a Statement of Use and are entitled to time extensions. An extension aids in protecting your rights and gives you extra time, but you must still supply proof of use by the new deadline that is set.
The Request for Extension of Time to File a Statement of Use (USPTO Form 1-751) allows you to extend your SOU deadline by six months per submission. You can file up to five extensions, amounting to 30 months in total, but this extension applies solely to the filing deadline and does not alter your original date of first use.
